Form 1040-NR: Essential Tax Information for Non-Residents

Enter any amount you paid with Form 1040-C for 2022. Do not follow the instructions in Line 29—American Opportunity Credit, in the Instructions for Form 1040. If your income is not exempt from tax by treaty, leave the rest of page 1 blank. If your income is exempt from tax by treaty, enter the exempt income on line 1k and leave the rest of page 1 blank. The form is divided into several sections, and you might need information from other tax forms to complete each section. Self-employed individuals with the US non-resident status who earn less than $400 a year don’t have to report their income on Form 1040-NR. Generating income from property rental, pensions, and other types of fixed, determinable, annual, or periodic income makes you subject to a 30% tax rate on the gross amount of such income. You must file Form 1040-NR even if you don’t earn anything from the business or trade you conduct in the United States during your stay. Recipients of taxable scholarships and fellowship grants are also required to prepare this form. Aliens and any U.S. citizens who leave the U.S. and relinquish their citizenship must pay an expatriation tax on all of their income and assets.

In figuring whether a gift is $250 or more, do not combine separate donations. For example, if you gave your church $25 each week for a total of $1,300, treat each $25 payment as a separate gift. If you made donations through payroll deductions, treat each deduction from each paycheck as a separate gift. 526 if you made a separate gift of $250 or more through payroll deduction.

B.  Which Income to Report

You must still meet (1), (2), or (3) below to be exempt from filing a 2022 Form 1040-NR. This year line 1 is expanded and there are new lines 1a through 1z. Some amounts that in prior years were reported on Form 1040-NR are now reported on Schedule 1 (Form 1040). Filing status name changed to qualifying surviving spouse. You are receiving a full scholarship from ABC University. You are not required to perform any services, such as teaching, research, or other services, to get the scholarship, and you have no other sources of income. The total amounts you received from ABC University during 2022 are as follows. If you make the election to be treated as a resident alien, your worldwide income for the whole year must be included on a Form 1040 or 1040-SR and will be taxed under U.S. tax laws. You must agree to keep the records, books, and other information needed to figure the tax.

Remember that you may also need Form 1040-NR you filed with the IRS the year before to determine the estimated tax payments and the amount applied from the previous tax year. The information you must include in this section of the form depends on the type of income you earned during your stay in the US. You may have to attach Form W2, SSA-Form 1042-S, Form RRB-1042-S, Form 8288, or Form 1099-R to this section.

Who should file Form 1040-NR?

See Line 17g under Instructions for Schedule 2 in the Instructions for Form 1040 for details on recapture of a charitable contribution deduction related to a fractional interest in tangible personal property. Enter the amount of any taxes from Schedule SE (Form 1040).

If you wish to modify your visa terms, you will likely have to show that you submitted any required tax forms. Attach any Form 1042-S you received for treaty-exempt income to Form 1040-NR, page 1. See Treaty-based return position disclosure, later.

If you received railroad retirement benefits treated as social security, you should receive a Form RRB-1042S. Except as provided next, include all dividends paid by U.S. corporations on line 1a. Include all U.S. source dividends paid by foreign corporations on line 1b. Include all dividend equivalent payments received with respect to section 871(m) transactions on line 1c. The withholding tax rate may be lower or the income may be exempt if your country of tax residence and the United States have a treaty setting lower rates.
